Okanagan BC Wines is an editorial wine review and information website. We publish original content including, but not limited to, wine reviews, winery profiles, grape variety guides, tasting notes, wine tourism information, and articles about British Columbia's Okanagan Valley wine region.

All wine ratings, scores, tasting notes, and opinions published on this website represent the subjective personal opinions of the author and are provided for informational and entertainment purposes only. They do not constitute professional advice of any kind, including but not limited to financial, investment, health, or purchasing advice.

3. Intellectual Property Rights

All content on this website, including but not limited to text, photographs, images, graphics, logos, icons, audio, video, software, data compilations, wine reviews, ratings, tasting notes, and the overall design and layout of the website (collectively, "Content"), is the exclusive property of Okanagan BC Wines and Lidia Didriksen, or is used with permission of the respective rights holders.

The Content is protected by Norwegian and international copyright, trademark, and other intellectual property laws, including but not limited to the Norwegian Copyright Act (Lov om opphavsrett til åndsverk, "Åndsverkloven").

6. Limitation of Liability

To the maximum extent permitted by Norwegian law and applicable international law:

  • Okanagan BC Wines, Lidia Didriksen, and any affiliated parties shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
  • Our total aggregate liability arising from or related to your use of the website shall not exceed the amount you have paid us (if any) in the twelve (12) months preceding the event giving rise to the claim.
  • We are not liable for any decisions you make based on the content published on this website, including but not limited to wine purchases, travel plans, or business decisions.
  • We are not responsible for the content, accuracy, or practices of any third-party websites linked from this website.

8. Indemnification

You agree to indemnify, defend, and hold harmless Okanagan BC Wines, Lidia Didriksen, and any affiliated parties from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorney's fees) arising from: (a) your use of and access to the website; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you submit to the website.

9. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Norway, without regard to its conflict of law provisions.

Mandatory Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, the website, or the Content, including the validity, interpretation, breach, or termination thereof, shall be resolved by binding arbitration in accordance with the Norwegian Arbitration Act (Lov om voldgift, 14 May 2004 No. 25), which is based on the UNCITRAL Model Law on International Commercial Arbitration.

  • Seat of Arbitration: Oslo, Norway.
  • Language: English or Norwegian, at the discretion of the arbitral tribunal.
  • Number of Arbitrators: One (1) arbitrator, unless the parties agree otherwise.
  • Institutional Rules: The arbitration shall be administered under the rules of the Oslo Chamber of Commerce (OCC), or such other rules as the parties may agree upon.
  • Costs: Each party shall bear its own costs, unless the arbitral tribunal determines otherwise.

Waiver of Class Action

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.

Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Consumer rights under mandatory Norwegian consumer protection law remain unaffected.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the revised Terms on this page with an updated "Last updated" date. It is your responsibility to review these Terms periodically.

Your continued use of the website after any modifications constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you must stop using the website.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction or an arbitral tribunal, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. The invalidity of any provision shall not affect the validity of the remaining provisions.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Okanagan BC Wines regarding your use of the website and supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written.
